Dealing with the appeal opinion

I am still trying to figure out what to do with the appellate opinion against. It was written by judge Mihara, and also signed by Bamattre-Manoukian and Duffy. A lawyer told me that these are three of the worst appellate judges in California, and they hardly ever reverse anything. They just rubber-stamp what the court does.

According to the rules, I have 15 days to request a rehearing. The opinion has a number of factual and legal errors, so I'll probably do that.

Maybe you are just wrong. Dealing with that might be your solution.

My thoughts exactly. If he would just pay the support and alimony the court required and quit slandering his ex wife, her husband and other court officials I'm guessing he wouldn't be in this situation.

I've followed this closely and it appears to be a case of a man who doesn't want to part with one red cent to support his kids or give his ex her fair share of the assets. I have a feeling that ex wifes new husband is probably much younger and better looking and more of a man than Angry Dad also causing some resentment.

If any of the legal things he's pointed out on this blog were in question or were not obviously the way he's indicating them, then sure. He might be legally wrong. But everything he has cited has matched a reasonable person's interpretation of the law. I have a feeling that the poster who constantly makes personal attacks against his age and appearance is probably doing so because she lacks the capacity to make a stronger argument, and so returns to that old staple, ad hominem.

Let me affirm your ad hominem attack! Yes. Sure. He's wrong because he's old and ugly! We all know old and ugly people are wrong! Don't we?

Whether he is wrong or right, several things are clear:

1. Our courts are not working at the minimal level required for citizens to have confidence that they are getting a fair hearing.

2. In combination with poor and incompetent representatives in the executive and legislative branches, in both parties, we are heading for a societal meltdown.

I think we've passed the point of no return.

Oh boy, is she back again? What's wrong, the sizzle of the backdoor affair not doing it for you anymore? Mad, cuz you aren't getting the shopping sprees you imagined when you ruined your daughters.

Umm, what exactly is 'her fair share of the assests"? Since you "followed this case so closely" maybe you can tell us where the disparity is. Something tells me we are in for along wait.
